(CBS4) – A father is being charged after his 3-year-old was shot and killed over the summer in Commerce City. Jose Rodriguez is now charged with child abuse resulting in death and possession of a weapon by a previous offender.

The shooting happened on July 16 at a home on Jasmine Drive. The child was home alone with two other children but those other kids weren’t hurt.

Police haven’t said yet who fired the weapon.

Rodriguez is being held on a $20,000 bond.

    Not sorry at all for this guy.

    First, he wasn’t supposed to have the firearm – and second, he left it LOADED where one of the children could find it. Add in that it appears that no adult was supervising the 3 children and you have a recipe for disaster (and Colorado is one of MANY states that does NOT have a “minimum age” when a child can be left at home alone – although there is a recommendation that a child be at least 10-12).

    I always thought one of my brothers went “over the top” when his sons started toddling and climbing when he put his UNLOADED handgun in a lock box kept on a shelf in one bedroom with the firing pin AND bullets in another lock box on a shelf in another bedroom, but maybe not.
