DENVER (CBS4) – A man wanted in a 1989 murder in Mesa County is now in custody.
Police arrested 67-year-old Rafael Garcia in Denver. They say he shot and killed Charles Porter in Palisade.
He was prosecuted under Mexico’s justice system in 2009 with the cooperation of Mesa County but they did not get a conviction.
Mesa County’s district attorney says he believes his office has the right to prosecute Garcia in the United States.
