Colorado Court Rejects Challenge For Highway Plan

DENVER (AP) - The Colorado Supreme Court has ruled that voters have no right to challenge the design of a new state highway entrance to Aspen.

The justices said Monday a 2007 petition to ask voters about the state's highway plans was out of line because the decision was made by administrators and not subject to voter initiatives.

The court ruled that the initiatives would circumvent a complex administrative process for the location and design of a state highway and changes would be too cumbersome.

Supporters argued they had the right to challenge the highway plan because the process was approved by state lawmakers.

Several justices disputed the ruling, saying there is no clear line between administrative powers of state officials and legislative oversight.
