Man Accused In Lincoln Street Murder Formally Charged

DENVER (CBS4) - A man accused of shooting and killing a 47-year-old father outside a nightclub last weekend has been formally charged.

Lynn Kimbrough with the district attorney's office said Marvin Joel Rosario-Lopez, 24, was charged with first-degree murder after deliberation and first-degree murder with extreme indifference.

"The charges allege that in the early morning hours of Sunday, Nov 4, Rosario-Lopez was involved in an altercation outside of a nightclub in the 1100 block of Lincoln Street and that he pulled a gun and shot Ronald Smith," Kimbrough said in a statement.

Smith later died.

Rosario-Lopez was detained by security guards at the scene, and was taken into custody. He remains in custody where he is being held without bond. He's scheduled to appear in court on Tuesday to be advised of the charges.
