Molly Midyette Trial Resumes On Monday
BOULDER, Colo. (CBS4) - A mother convicted in the death of her baby boy returns to court Monday.
Molly Midyette is trying to get a new trial. She claims she was incompetent to assist in her own defense during her original trial in 2007 because of battered woman syndrome.
Midyette was convicted of child abuse in the death of her 10-week-old son. She says her husband and his family manipulated and bullied her during the trial.
If she wins the appeal it would set a precedent. It is an argument Colorado courts have not previously addressed.
