Attorney: Indicted Trooper's Statements Invalid

GRAND JUNCTION, Colo. (AP) - A defense attorney says statements made by one of two Colorado State Patrol troopers indicted in the death of an unarmed Redlands man should be invalid.

The Daily Sentinel of Grand Junction reports that Denver attorney Harvey Steinberg wants statements made by Cpl. Kirk Firko thrown out. Steinberg made his arguments filed in documents filed earlier this month in the death of Jason Kemp.

Steinberg says authorities didn't advise Firko that he had a right to remain silent during the administrative investigation.

Firko and Trooper Ivan "Gene" Lawyer are accused of kicking in Kemp's door while investigating a traffic accident July 20, 2010. Kemp was unarmed but Lawyer told the grand jury he saw a flash and thought he had been shot so he fired at Kemp.
