DENVER (CBS4) – A baseball fan who fell down a stairwell during a Rockies game at Coors Field on Tuesday has died.

Witnesses told police Robert Seamans, 27, of Pueblo, fell while sliding down a rail. It happened during the first doubleheader game against the Arizona Diamondbacks.

    I’m sure the family will now sue the Rockies organization for $50 million and say its for negligence and mental anguish. The negligence would be something like the 4 foot tall stairwell barrier should have been 4 feet, 2 inches tall. Then the stadium will have to retrofit all the stairs and raise hot dog prices from $9.50 each to $13.75 each.

    Sounds like a bargain to me!

    well, it is really too bad that something so intentioned for fun turned out so badly … and this is exactly why we tell our kids to ‘be safe’ and all the other axioms of life that pertain to one’s safety and well-being as our kids are growing up. Clearly, he should have considered all the options and consequences of his intended actions, as in ‘looked before he leaped’ … but do we ever really think anything is going to happen to us? … so, maybe we should consider that option before making a decision to do something that could turn out very badly … as my 10 year old grandson is currently in surgery to pin together a busted arm from a fall off the top of a jungle gym where he shouldn’t have been either… just like this man, if he hadn’t been up there, he wouldn’t be in surgery today … my sympathy to the family.

Sliding down a banister has a foreseeable consequence, not unlike hanging out a window too far and slipping: you get injured or die. The new fad of planking has led to fatalities and devastating injuries. Everyone does stupid things when they’re young. But today’s stupidity is unparalleled.

Fences like 12 feet high, big-a signs all around, etc. Some 15yr old manages to get into the area and get electrocuted climbing on the buzzing high voltage equipment. YES – the parents of this little moron sued. And let it play on out; say the company had concertina wire on top of the fence and at the base of it (where the kid squeezed under in the gravel). He’d have gotten “boo-boos” and they’d still have sued. Yeah, whatever – “Good Night, John Boy…”

    I worked at a sports arean and had occasion to tell a few SYMs (stupid young males) to stop or not slid down a rail. (I was not security so had no way to actually enforce without help from police or security) One or two ignored, flipped me off or just smilled and did it anyway. The person responsible for this tragedy is dead. When I heard the fall was caused by his irresponsible action I thought of the last SYM I watched slid down a rail laughing at my instructions to stop before he hurt himself or others. At least he was the only one hurt although his actions could have injured others.

The commenters also understand the financial settlement comes not from pixie dust but are the reason we pay outrageous prices for everything we purchase. Every seller of every product prices litigation and settlement costs into their product and we all pay.

    The commenters anticipate the same in this case – survivors sue, get a bundle, and we pay.

    I lived in Pueblo back in the early seventies. Pueblo was OK but I met some real charaters there. I once read about some guy who was jumping from cage to cage in the Pueblo Zoo one night after a night of boozing and what not. This guy jumped into the polarbear cage and barely made it out alive. It is a very gratifying feeling know there are a lot of people who feel and think as my husband and I do. We too are sick of the sheep trying to get a free ride and thinking everything is hunky dorey. We say get a clue people and pull your head out and look around you, and then shut the heck up if you won’t see what we do.

    Wow, what? At 27 years old, he was a grown man. Adults are presumably smart enough to know how to conduct themselves in public. Personal responsibility is the issue here — he assumed the risks of his actions when he took them. The social compact in America is (or theoretically is, anyway) that in exchange for vast liberties, one will act responsibly and make positive contributions. In this case, neither was present.

    It is in no way “cruel and inhuman” to recognize stupidity for what it is. Perhaps instead of falling all over yourselves to demonstrate your vast empathy, you would be better served to consider this tragic event in its proper context — had a grown man not been acting a fool in a public place singularly ill-suited for the behavior he chose to engage in, he would be alive today. Personal irresponsibility led to this man’s untimely death.

    The saftey railings that we put around stairwells and other hazards seem innocent enough. But new evidence shows that they are often slippery and pose a danger when people stand on them, slide on them, or balance bicycles on top of them. This hidden danger in our midst is a scandal. Now the government is going to have to legislate that all safety railings have saftey railings so that people don’t try doing stunts on them..

    I am thinking that perhaps alcohol may have had something to do with this “accident”. Maybe the answer is to provide the beer vendors with portable breathalyzer and prohibit sales to anyone who is inebriated. Of course the owners will have to raise tickets prices from 75.00 to 300.00 to make up the shortfall and keep paying themselves and their players a kings ransom.

    Funny how the lawyers always get blamed. If there were no clients, no one coming into their office saying I want to sue, there would be no lawsuits. And lawyers can’t whisper in anyone’s ear – that’s called soliciting and is an ethical violation. Plaintiffs personal injury attorneys, which is really who you are criticizing, can and do however encourage these suits with billboards and ads saying, “Injured? Sue now”

    While it was a stupid move, simply he was not thinking clearly and it is unfortunate that he had to lose his life over something so stupid. However, he did die and whining about punctuation and politics does neither bring him back or help him to realize what he did was stupid. People control their own destiny, this has nothing to do with Obama, security or even safety barriers. There is only so much protection that can be offered, everything else is left up to the individual to control. So while everyone wants to whine and complain, just remember someone lost their life, lets just say yes it was stupid, but we are feeling some sort of remorse for the family who lost a loved one.
