Plea Deal Approved In Cyclist Hit-And-Run Case

EAGLE, Colo. (AP) - A Denver man is charged with misdemeanors in a hit-and-run accident near Avon that left a New York doctor seriously injured and prompted criticism of the prosecutor for not seeking more serious charges.

Eagle County District Judge Frederick Gannett approved a plea deal with 52-year-old Martin Erzinger Thursday. The financial adviser is accused of hitting cyclist Steven Milo in July and driving away.

Erzinger's attorney says his client has a sleep disorder and dozed off.

Milo, still recovering from several injuries, asked the judge to reject the plea deal.

Prosecutor Mark Hurlbert says he offered the deal because Erzinger has no criminal record and is willing to pay a significant amount of restitution.
