Man Charged In 2010 Cold Case Sexual Assault After Victim Passed Away

DENVER (CBS4)- A man has been charged in connection with a 2010 cold case sexual assault of a teenager, even though the victim passed away in 2012.

Denver District Attorney Mitch Morrissey has formally charged Gabino Otero-Labra with one count of sexual assault.

The charges allege that on March 29, 2010, Otero-Labra sexually assaulted a 13-year-old girl whom he had befriended. Otero-Labra was 24 years old at the time of the assault. The assault allegedly occurred at Otero-Labra's home in the 3900 block of Kalamath Street.

The case was unsolved until Denver's Cold Case Project received a report last month of a DNA match to Otero-Labra who is in custody in Minnesota on an unrelated case.

The victim passed away in 2012 from a brain tumor.
