Nancy Jo Arias, 39, was convicted in June of manslaughter and vehicular homicide in the death of her husband Phillip Anthony Lobato last summer.

Arias said she and her husband were having a heated argument in the car in which he hit her with his hand. She says she told him to get out of the vehicle but says he continued to hit her through the open window.

At the time Arias had a blood alcohol content that was twice the legal limit.

During her trial, prosecutors argued her husband was no longer a threat at that point and Arias had many other choices she could have made.

Deputy District Attorney Kristen Wiest told the court that the case was the result of "the tragic circumstances of the couple's lives and the domestic violence that went on in that home.

"This is about the loss of a life," she said. "It was a brutal way to die. He was run down with a car. His foot was nearly severed."
