U.S. Supreme Court Wants Another Review Of Colorado TABOR Suit

DENVER (AP) — The U.S. Supreme Court is ordering a lower court to take another look at a Colorado challenge to the Taxpayers' Bill of Rights.

Some state lawmakers are challenging TABOR, saying it violates the division of powers. The plaintiffs say that the job of levying taxes is up to the legislative branch, and that requiring a public vote prevents that branch of government from doing its job.

One of the questions lawmakers must answer in the lawsuit is how they've been harmed by the requirement that voters agree to taxes. The 10th Circuit Court of Appeals ruled last year that the lawmakers do have standing to sue.

The nation's high court on Tuesday ordered the 10th Circuit to take another look. That comes after an Arizona redistricting case also involving state lawmakers.
