3 Accused Of Murder In North Denver Formally Charged

DENVER (CBS4) - Three men have been formally charged in connection with the murder of a man who was living on former state Rep. Frana Mace's property.

According to Lynn Kimbrough with the district attorney's office, Chad Baluska, 38; Eric Fuhs, 25; and Derek Webb, 28, are each charged with first-degree murder after deliberation, two counts of felony murder, burglary and aggravated robbery.

Samuel Grady, 61, was found dead near the intersection of 49th and Green Court.

"The charges allege that on May 6 the three defendants went to the victim's home in the 4900 block of Green Court, shot him, then stole his wallet and his truck," Kimbrough said in a statement. "Baluska was arrested in the stolen truck the next day."

Fuhs is Grady's nephew. He was arrested on May 9. Webb was arrested on May 11.

Former state Rep. Frana Mace lived on the property until her death in March at age 80. Family members told CBS4 Grady had been living in the carriage house on Mace' s property. He was the ex-husband of Mace's daughter.

All three remain in custody without bond. They are scheduled to appear in court on Wednesday to be advised of the charges.
