Police Announce Arrest In Burglary Case Where Homeowner Fired Shots

DENVER (CBS4) - Police in Denver on Tuesday announced the arrest of an 18-year-old male in connection with a burglary and car theft case.

Marquies Jackson is suspected of being one of the two suspects who tried to break into a woman's house in the 7700 block of East Exposition Avenue on Monday.

The crime took place at approximately 2 a.m. Police are still investigating what happened, but the initial report was that the suspects tried to get into the woman's house through a bathroom window.

The woman apparently got scared and fired at them while they were still outside.

"Obviously she felt threatened so she took some measures," said Sonny Jackson, Denver police spokesman.

The suspects fired back, and one of the bullets ended up hitting a neighbor's SUV and smashing the back windshield.

Moments later the suspects stole the homeowner's blue 2012 Toyota Highlander and drove off.

There's no word so far on whether the Highlander was located. On Monday police said they were hoping for the public's help in locating the car, which had the license plate ACF9582. Police also haven't released a description of the second suspect.

No one was injured in the crime, and so far there's some question about whether the homeowner might face some charge. Colorado's Make My Day Law may come to mind, but the statute applies to the use of physical force within a home. Denver police said the exchange of gunfire happened outside her home.

Legal experts CBS4 interviewed said self defense statutes may justify the homeowner's actions of firing shots at the suspects, but it's too soon to tell because so many details surrounding the shooting are still unknown.

"We have a lot more work to do," Jackson said.
