Jury Finds Man Guilty Of Attempted Sexual Assault On Teen Girl

GOLDEN, Colo. (CBS4) - A jury has found a 21-year-old man guilty of three felony counts for the attempted sexual assault and attack of a 15-year-old girl in Littleton.

Xavier Sebastian McDaniel, 21, was accused of breaking into the teen's home on April 4, 2013, and attempting to sexually assault her.

"The teenage victim came home from school and called her mother to check in. She had just settled in front of the television with a snack when Xavier McDaniel, who lived in the same apartment complex as the victim, walked into her home," Pam Russell with the Jefferson County Sheriff's Office said in a statement.

Russell said McDaniel checked to see if anyone else was home and then told the victim to take her tank top off, but she refused.

"McDaniel attacked the teen, repeatedly punching her in the face and head. She fought and struggled in her attempt to escape. When McDaniel's hand was clasped over her mouth she bit him, drawing blood," Russell said.

According to Russell, McDaniel then dragged the victim into a bedroom and removed her shorts while the victim continued to struggle. She eventually freed herself and McDaniel ran out of the apartment. The victim saw him leave through a window and called 911.

DNA left at the apartment confirmed McDaniel as the attacker.

Russell said the victim suffered a "subdural hematoma, lacerations, bruising and fractured a tooth. Blows to the head caused her to lose consciousness more than once."

Sentencing has been set for April 17. McDaniel faces a mandatory minimum prison sentence of 10 years up to life.
