Police in Commerce City were called to her home Feb. 14 in the 6400 block of Siegal Court where they found the boy, called Gabe by his family, unconscious. Trujillo, 60, told investigators the boy had fallen.

Police took her into custody the next day after it was determined the boy's injuries were not consistent with a fall.

"Investigators came over and asked if I ever saw the kid in the yard without any clothes on and I thought that was odd. I said no," said neighbor Eva Gallegos.

Neighbors were surprised to hear of his death.

"There have never been any problems up there. No police and you never heard her raise her voice at the children and would hold on to that boy like he was the dearest thing in the world," said neighbor Earlene Brophy.

Gabe's aunt told CBS4's Jennifer Brice that her mother would never do anything to harm her grandchildren. Other family members said that Trujillo told them Gabe fell out of a chair. They also said social services had been called to investigate allegations of abuse prior to his death.

Police said Gabe was being cared for by Trujillo, who had custody of him and his two older sisters.
