City To Appeal Controversial Ruling To Reinstate Officers

DENVER (CBS4)- The City of Denver will appeal a controversial ruling to reinstate two fired police officers.

Officers Kevin Devine and Ricky Nixon were fired for lying about an incident at the Denver Diner in July 2009.

A HALO camera captured the incident in which Officer Ricky Nixon threw down handcuffed suspects and pepper sprayed a woman in the face.

Another officer, Kevin Devine, is seen on the video confronting another woman and pushing her to the ground. The 2009 incident was all captured on a halo camera. Nixon and Devine were fired for filing inaccurate reports from that night, but will now return to the force after a civil service panel reinstated them.

The Civil Service Commission announced last week that the officers should not have been fired. City attorney Doug Friednash said his office will appeal. He also wants the commission to delay the officers' reinstatement until after the appeal is heard.
