Teen Sentenced In Sex Assault Of Girlfriend Who Was Later Found Dead

GREELEY, Colo. (CBS4)- A 19-year-old convicted of sexual assault for having sex with a 12-year-old Greeley girl who disappeared a year ago and then was found dead, has been sentenced. Robert Montoya was sentenced to 8 years to life on Friday.

Montoya was convicted on two counts of sexual assault, one involving a pattern of abuse, in March. If he is ever released from prison, Montoya will serve a mandatory parole sentence of 20 years to life and must register as a sex offender.

Montoya did make a statement in court, "That I'm sorry for what I've done."

The judge who handed down the sentence has recommended that Montoya go to a facility for the disabled. The defense claimed he was developmentally disabled.

"You didn't have a fair childhood. With that high level of dysfunction, that does not justify you having sexual intercourse with multiple times with a child," said Judge Marcelo Kopcow.

"He was subjected to abuse, himself, both physical and sexual. He grew up without a father figure," said Defense Attorney Kevin Stroble.

The conviction stems from Montoya having sex with Kayleah Wilson, his friend's younger sister, when he was an adult, and Wilson had just turned 12.

Wilson disappeared in March 2010 and her body was found in a drainage ditch in Greeley nearly two months after she was reported missing.

Police had focused on Montoya as a potential suspect in Wilson's death, but they never named him as a suspect. The investigation into who killed Wilson continues more than a year after her body was found.
