Condo Residents Upset Over Construction Mess

DOUGLAS COUNTY, Colo. (CBS4)- Condominium owners are upset they have to live in a mess while their town home complex is under construction for repairs. The Carlyle Park condos are located at Lucent Boulevard and Highlands Ranch Parkway in Douglas County.

Owners have been told by their association that there is no money to put them up in other housing while repairs to fix building defects are completed. The repairs are possible thanks to a more than $10 million settlement of a lawsuit over the defects. But it's not enough to keep residents from living in a construction zone.

The lawsuit is one of many involving multi-family developments by D.R. Horton of Fort Worth, Texas. The settlement money is being used to repair defects like cracks in the foundation and drainage problems.

"The community is in a situation where they have less than enough money to do the repairs they need to make. So they need to do so as efficiently as possible," said HOA Attorney Jerry Orton.

Orton said a third of the settlement went to lawyers from another firm that handled the case. Homeowners aren't happy.

Repeated calls and emails to D.R. Horton were not returned.
