Molly Midyette Heads To Court With Hopes Of A New Trial

A mother convicted of child abuse in the death of her 10-week-old son headed to court Monday in what is expected to be a week-long legal fight to try to get a new trial.

Molly and Alex Midyette were both found guilty on different charges in separate trials following their 10-week-old son Jason's death in Louisville in March 2006. Molly was found guilty of child abuse resulting in death in December 2007 and sentenced to 16 years in prison. Jurors ruled she failed to seek help for her injured son. Alex was found guilty of criminally negligent child abuse in 2009 and was sentenced to 16 years in prison. He was acquitted of a more serious charge of knowingly or recklessly causing the injuries that led to the boy's death. The couple turned themselves on May 8, 2007.

A woman convicted in the death of her 10-week-old son is trying to convince a judge she deserves a new trial on the argument that her ex-husband and family allegedly influenced her ability to defend herself in court.
