Road Rage Shooting Suspect Person Of Interest In Other Murder

By Tom Mustin

DENVER (CBS4) - An arrest in a road rage case in Denver may help solve another murder.

Apparent road rage victim Miguel Baray died Saturday after being shot near West Kentucky Avenue and Federal Boulevard. CBS4 has learned the man accused of shooting him is a person of interest in a deadly shooting Thursday.

"Mary" didn't want to use her real name after the murder of her cousin, Baray.

"He was their world," she told CBS4's Tom Mustin.

On Nov. 26 the married father of two young girls had been returning home near Kentucky and Federal.

"His girls were in a wedding at church. He was going to see them walk down the aisle. He didn't get to see them," said Mary.

Police say Baray had been stopped at a stop sign when career criminal David Garcia, 28, honked his horn. Garcia told police Baray raised his middle finger, so Garcia drove up next to him and shot him to "prove a point." Baray died from his wounds.

"His wife thought the world of him. Her life will never be the same," said Mary.

Mary spent Thanksgiving Day with her cousin. She says Baray was an avid Broncos fan. He was quiet and hardworking, and adored his wife and daughters.

"You're supposed to go to work, be good, work hard, do the right thing, and everything is going to be okay. That's not what happened for him," she said.

Police arrested Garcia on Monday. He's also a person of interest in another homicide that occurred on Thanksgiving Day.

Denver Detective John White says in road rage cases drivers should do their best to avoid confrontations.

"Do not stop. Do not roll down your window to engage that person in a conversation. That can only escalate the situation," White said.

Now, after another senseless act of violence, a heartbroken family is trying to pick up the pieces.

"There are still good people out there. These girls are going to honor him and be good people too," Mary said.

Garcia has a lengthy criminal record, including arrests for everything from aggravated assault, to domestic violence and burglary. He's now facing a new charge of first-degree murder.
