Sexual Assault Charges Dismissed Against Canadian

DENVER (CBS4)– The Denver District Attorney’s Office dismissed sexual assault charges against a man from Canada on Monday.

Colby James Messer was charged in April with six counts of sexual assault in connection with what was called a brutal sexual assault of a 27-year-old woman at a Denver hotel in November 2015.

According to Lynn Kimbrough with the Denver DA’s office, new information led to the determination that those charges could no longer be proven beyond a reasonable doubt.

The DA’s office released this statement, “Prosecutors have an ethical duty to dismiss charges if they determine there is no longer sufficient evidence to prove a case beyond a reasonable doubt.”

    After hearing the other, less sensationalist, side of the story I knew that the charges would be dropped – but would have bet not until after the Nov 8 election for the Denver District Attorney.

    Colby’s name was splashed and smeared all over the media and will come up again whenever his name is Googled for the rest of his life. The family is out $100’s of thousands and thoroughly traumatized. They will undoubtedly be happy to just go home while the DA and the media quietly wait for the topic to be forgotten.
