Theater Shooting Trial Continues Without Jury

CENTENNIAL, Colo. (CBS4)- Testimony continued in the theater shooting trial on Friday but without the jury.

One juror got sick and had to leave, so the judge dismissed the entire jury for the day. Both the defense and prosecution agreed to continue with testimony that would be videotaped and played for the jury at a later date.

James Holmes was convicted last week in the Aurora theater shooting that left 12 dead and 70 others injured on July 20, 2012.

This phase of the sentencing phase deals with mitigating factors where former friends and teachers of Holmes take the witness stand and describe the gunman. For the most part they have said that while shy and quiet, he was a regular child and teenager.

An employer of Holmes' father, Bob, indicated there were problems in the months before the shooting.

"In and around the year 2012 Bob needed to take time off from work. He was concerned that he needed to come to Denver and he needed to visit his son because they had lost contact with Jimmy," said witness Scott Zoldi.

An alternate juror was questioned about a Metallica T-shirt he wore in court on Thursday. That shirt showed a man getting shocked in an electric chair. The juror told the judge he wore it because he liked the group and didn't expect to be in the courtroom.

Testimony wrapped up at 12:40 p.m. on Friday and will continue Monday morning.
