Theater Shooting Prosecutors Hit Halfway Point In Their Case
CENTENNIAL, Colo. (CBS4) - Jurors are getting a couple days off in the Aurora theater shooting trial. They heard more testimony all last week and will pick up again on Tuesday after the holiday weekend.
Prosecutors have indicated they are about half done with their case and will soon be getting to the mental health evidence. That is critical because defendant James Holmes has pleaded not guilty by reason of insanity.

Under Colorado law the burden is on the prosecution to prove that he was sane at the time of the theater shooting. That means basically that he knew the difference between right and wrong.
The district attorney will present the results of two psychiatric exams by the state that they say found him to be sane on July 20, 2012. But the defense has told the jury that their client was suffering from schizophrenia and should be found not guilty as a result. They will begin their case in late June.
