No Charges Filed In Deadly Accident At Boulder RTD Station

BOULDER, Colo. (CBS4)- Police in Boulder have completed the investigation into a deadly accident in November 2014 at the downtown RTD bus terminal.

Passers-by notified police on Nov. 6, 2014 after seeing a man laying in the on-ramp where the buses enter the roadway. He was pronounced dead at the scene and later identified as Charles Marcus Dial.

Police said Dial, 62, was stuck by a vehicle near the exit of an RTD bus terminal at 14th Street and Canyon Boulevard.

Tests from the Colorado Bureau of Investigation indicate that the rear tires of an RTD bus ran over Dial. There is no physical evidence on the front or sides of the bus which would indicate that the bus hit Dial, causing the victim to fall.

Police are still unsure of how he came to be lying in the bus exit area. There were no eyewitnesses.

At the time of the accident, the bus driver was driving slowly and had stopped twice before entering the road: once at the pedestrian crossing and again before merging with traffic. He did not see the victim and was unaware that the victim had been run over.

Because there is no evidence that the bus driver hit the victim and because there is no evidence which indicates the driver drove in a careless or reckless manner, no charges will be filed against him.
