2 Suspects In Custody After Manhunt In Commerce City

COMMERCE CITY, Colo. (CBS4) - Two men are in custody after an officer-involved shooting in Commerce City Saturday afternoon.

John Jacoby, 44, and Andrew Hurtando, 39, are being held for investigation of possession of a Schedule II substance with the intent to distribute, obstruction and possession of an illegal weapon.

Police say the shooting happened as officers were acting on a tip about an Arizona homicide suspect in the 7800 block of Locust Court just before 2 p.m.

One of the men the police wanted to question for the homicide in Arizona tried to run away, which led to the gunshot. But CBS4 learned the two men are not connected to the homicide.

The peace of the residential neighborhood was shattered by a single gunshot.

"One individual apparently fled out the back of the townhome and then fled back towards the townhome," Detective Mike Saunders said.

Police say a veteran sergeant met the suspect in the backyard, and feeling threatened, he fired his gun.

"It's my understanding that the individual may have reached into his waistband, either for a weapon, or he reached into his waistband acting like he had one," Saunders said. "The officer felt threatened at that time and fired one round."

Nobody was shot, but the noise had neighbors running for cover.

"We were like, 'Go into your room, go run, go hide.' And I was like, 'Oh my gosh.' And my heart was beating so fast," neighbor Dominique Dreiling said.

A witness described the experience of seeing multiple officers with guns drawn collaring the suspects.

"It kind of freaked me out because I see this stuff on TV. I've never seen this in real life, you know, it was performing right front of my eye, and it was cool," neighbor John Ortiz said.

Adams County will be reviewing the gunshot fired by the sergeant.
