Security Guard In Fatal Westminster Shooting Won't Be Charged

WESTMINSTER, Colo. (CBS4) - A security guard who shot and killed a Westminster man this month will not face charges, the district attorney's office said Monday.

The guard, Gustav Ruppel, shot 24-year-old David Ludewig on Aug. 2 after a confrontation at the victim's apartment complex.

"There is insufficient evidence to disprove that Mr. Ruppel was acting in self-defense," District Attorney Dave Young said in a letter to Westminster Police. "Accordingly, we will not be filing criminal charges in this matter."

Witnesses said Ludewig, who had been drinking, was celebrating news his wife was pregnant. Ruppel confronted him about urinating on a trash bin at approximately 1:30 a.m.

Ludewig entered his apartment and returned with an airsoft gun that fires pellets and allegedly aimed it at Ruppel, who then shot Ludewig.
