No 3rd Trial For Texas Man Accused In Wife's Death In Colorado

DENVER (AP) - Prosecutors have decided not to pursue a third trial for a Texas man accused of killing his wife near the couple's Colorado vacation home.

Juries in two Colorado counties previously considered the allegations against Frederick Mueller, but did not reach a unanimous verdict. Prosecutors announced Tuesday they were dismissing the case, canceling a third trial that was scheduled for January.

Seventh Judicial District Attorney Dan Hotsenpiller says a unanimous verdict in a third trial was unlikely and that prosecutors did not have new evidence to present.

Mueller's wife, Leslie Mueller, drowned near Lake City in May 2008. Frederick Mueller, of San Angelo, says she fell over an embankment and into a creek during a hike. Prosecutors contended that the evidence suggested she was held down in the water.
