DENVER (AP) — Both sides in the Colorado theater shootings case are objecting to a request by Fox News reporter Jana Winter to delay a September hearing on a story she wrote about defendant James Holmes.
Winter wants to wait until after judges in her home state of New York rule on her request to reject the Colorado subpoena.
In a filing Thursday, prosecutors said a delay could ultimately postpone the trial.
Holmes is accused of killing 12 people last year.
Citing unidentified law enforcement officials, Winter reported Holmes sent a psychiatrist violent drawings.
Holmes’ lawyers say Winter’s sources violated a gag order. They say officers may have lied when they denied being Winter’s source, undermining their credibility as witnesses.
Winter could face jail if she refuses an order to identify her sources.
