Judge Mulls Request On Theater Shooting Victims

CENTENNIAL, Colo. (AP) — The judge in the Colorado theater shooting is rescinding an order to bar witnesses from the courtroom during testimony from other witnesses, as he considers prosecutors' request to let alleged victims attend the trial and key hearings.

James Holmes has pleaded not guilty by reason of insanity to killing 12 people and injuring 70 others on July 20.

Judge Carlos Samour this month conditionally granted defense attorneys' request to bar witnesses from the courtroom until they testify, with an exception for Holmes' parents so they could watch the trial. Prosecutors say any of the hundreds of people in Theaters 8 and 9 during the shooting also should get to attend, even if they testify.

Samour said Thursday he'll issue a new sequestration order when he rules on prosecutors' request.
