Former High School Athlete Accused Of Sex Assault On Overdose Victim

SIMLA, Colo. (CBS4)- A former high school athlete and another teen have been accused of sexually assaulting a 15-year-old girl after she overdosed on drugs and alcohol in the small town of Simla.

Logan Potter and another teen, Eric Plowman, have been arrested in the case. Potter, 18, faces charges on three counts of sexual assault. Plowman, 19, faces charges on selling prescription drugs and alcohol to the 15-year-old victim.

Simla Chief of Police Jim Leach said teenagers are searching for entertainment in the small town with a population of 700.

"There's a lot that like to drink. There's not enough for them to do. A lot of them get together and drink and they want to party," said Leech.

In the small town all the kids hang out behind the cemetery underneath an old railroad bridge. That was where the alleged sexual assault happened.

"Her blood alcohol was almost a .30 and then mixed with that Vicodin, it as almost lethal," said Leach.

Leach said a rape kit revealed that she had been sexually assaulted. The girl apparently didn't remember what happened but she did remember where she obtained the prescription medication and alcohol.

"She said that she purchased Vicodin as well as the alcohol," said Leach.

Plowman was arrested for selling the prescription drugs and alcohol to the teenage girl. Plowman has bonded out of jail.

Potter's mother, Amy Whitaker, said the girl was not raped.

"They were already intimate without her boyfriend knowing," said Whitaker. "My boy knows no means no and it's not a game."

Potter remains in jail. His family said they can't afford the $50,000 bond to release him.
