DENVER (AP) – The judge in the Colorado theater shootings has postponed a hearing on an attempt by defense lawyers to force a Fox News Channel reporter to reveal her sources.

The hearing had been scheduled for Monday on a subpoena for reporter Jana Winter to testify about who told her what was in a notebook that suspect James Holmes sent to a psychiatrist.

In an order made public Wednesday, Judge William Sylvester granted a defense request to delay the hearing until April.

Defense lawyers said they have not had time to prepare. Prosecutors objected, saying defense lawyers have had plenty of time and have not justified the delay.

Holmes is charged with killing 12 people and injuring 70 in the July 20 shootings. He has not entered a plea.

Winter wrote a news story shortly after the shootings citing unnamed law enforcement sources in describing the contents of the notebook. Holmes’ lawyers contend the leak violated a gag order.

In his order granting the delay, the judge said he wanted to avoid any pretrial errors that could be grounds for a new trial.

Fox News said it can’t comment on pending legal matters.
