BOULDER, Colo. (AP/CBS4) – A Boulder County man suspected of causing a wreck that caused a pregnant woman to lose her baby has been charged with vehicular assault.
The Daily Camera newspaper reports that 52-year-old Gary Sheats of Longmont is also charged with DUI, careless driving and leaving the scene of an accident.
Prosecutors say Sheats had a blood-alcohol level of 0.292 percent after the crash earlier this month, more than three times the legal limit for driving.
Boulder District Attorney Stan Garnett said on Tuesday that Sheats wasn’t charged with vehicular homicide because under Colorado law a baby is considered a fetus and part of the mother until born
Sheats is being held at the Boulder County Jail on a $100,000 bond.
Heather Surovik, the victim, remains in the hospital.
