Eastern Colorado Marshal Accused Of Sexual Assault

LOG LANE VILLAGE, Colo. (CBS4) – A small town marshal is now behind bars accused of sexually assaulting a woman. Investigators say the alleged victim was drunk at the time.

Edwin Irizarry-Urrutia was arrested last week. Police say the assault took place two weeks ago.

Irizarry-Urrutia is the marshal of Log Lane Village near Fort Morgan in eastern Colorado. He’s being held in the Logan County Jail instead of the Morgan County Jail out of safety concerns because he’s arrested some of the inmates in the Morgan County Jail.

About 900 people populate Log Lane Village and most everybody knows Irizarry-Urrutia and they call him “Izzy.”

“He flirts a lot. He flirts with all the girls,” a female resident told CBS4. “He doesn’t act like a cop.”

“We had received a call from her later the next morning about the incident. After that is when we started the investigation,” Lt. Jared Crone with Fort Morgan police said.

The woman told Fort Morgan police she and her female friend went to Irizarry-Urrutia’s house the night of Sept. 15. She said she consumed two drinks and two shots and became very drunk. According to the arrest affidavit she vomited twice and kept saying she felt ill.

After getting sick, she told police Irizarry-Urrutia and her friend took her clothes off. Her friend left and that’s when she said Irizarry-Urrutia started touching her. The alleged victim told police she didn’t say “no” and didn’t physically push Irizarry-Urrutia away, but said she was drunk. Then, when the friend returned, the three had sex, according to the arrest affidavit.

The victim’s friend told police she heard the woman ask Irizarry-Urrutia to stop and he did, but the friend felt sorry for the victim and felt Irizarry-Urrutia had put them both in a bad situation.

Irizarry-Urrutia is being held on a $50,000 bond. He’s also been suspended without pay.

Police said they have not ruled out charges against the alleged victim’s friend as well.
