Officer In Botched Murder Probe Re-Indicted

FORT COLLINS, Colo. (AP) -- Fort Collins police Lt. James Broderick faces new perjury charges from a botched murder investigation after the original charges were dismissed.

The Fort Collins Coloradoan reports a new indictment was announced Thursday.

A judge dismissed a 2010 indictment, saying the three-year statute of limitations had expired.

The new indictment argues the statue of limitations hasn't expired. It says the alleged perjuries were discovered in October 2007 or later. It argues that 10 months of the intervening time doesn't count against the deadline because charges were pending in that period.

Broderick's attorney didn't immediately return an after-hours phone message.

Timothy Masters was convicted of murder in 1999 and sentenced to life. He was released in 2008 and formally exonerated last month after DNA evidence failed to place him at the crime.
