Man Loses Bid To Use Marijuana While On Probation

ASPEN, Colo. (AP) – A judge says a man convicted of breaking into an Aspen pharmacy to try to steal oxycodone can’t use marijuana for medicinal purposes while on probation.

The Aspen Times reports Nathan Benner, 23, had sought permission to use marijuana to cope with shoulder pain. Otherwise, using pot would violate terms of his deferred sentence over the 2009 break-in.

Pitkin County District Judge Gail Nichols rejected Benner’s request Monday. She suggested Benner take up yoga or some other method of dealing with pain instead.

    I think anyone who is on probation should not be allowed access to Medical Weed….. hmmmmm and if there is a urine test and they test positive they get to suffer along with those who break the law….because isn’t that what they are doing….
