Judge Rules Against Motion In Midyette Case

BOULDER, Colo. (AP) - The ex-husband and father-in-law of a Boulder County woman seeking a new trial in her infant son's death won't be allowed to present their own evidence in the case.

Molly Midyette is seeking a new trial in the death of her son, 11-week-old Jason. The former Louisville woman was convicted in 2007 of child abuse resulting in death and sentenced to 16 years in prison.

Midyette has said she was so manipulated by her husband and his family that she couldn't defend herself and deserves a new trial.

Her former husband, Alex Midyette, is also serving 16 years for their son's death. He and his father wanted to file motions disputing Molly Midyette's claims. The Daily Camera reports a judge says the law doesn't allow third parties to intervene in criminal matters.
