Mother In Prison For Child Abuse Seeks New Trial

BOULDER, Colo. (AP) -- A former Louisville woman serving a 16-year sentence for her infant son's death is seeking a new trial on claims that she was so emotionally abused and manipulated by her husband and his family that she couldn't adequately defend herself.

The request for a new trial filed by Molly Midyette's attorneys and obtained Thursday by the Daily Camera in Boulder says her former attorneys should have told jurors that she was suspicious her husband caused their son's death.

Her former husband, Alex Midyette, is also serving 16 years for the death of 9-week-old Jason. The boy had multiple broken bones and brain damage when he died in 2006.

An attorney for Alex Midyette's family calls the mother's claims "desperate allegations."
