New Details Released In Crash Involving Colorado State Senator

DENVER, (CBS4) - Investigators said on Wednesday that Colorado State Senator Suzanne Williams moved her three-year-old grandson into a child seat after he was ejected in a deadly crash in Texas.

The accident happened Dec. 26 along US Highway 385 northwest of Amarillo, Texas.

According to the report, Williams crossed the center line, and although the driver of the oncoming SUV tried to avoid her, he couldn't. The two vehicles collided head on in the center of the road.

Her grandson and her son were not wearing seat belts and were thrown from the vehicle.

According to a preliminary accident report released Wednesday morning, Williams put her grandson back into her car after the crash.

"Who would leave their own 3-year-old grandson lying in the middle of the road? I mean, nobody would do that," said Williams' attorney David Lane.

He said to imply that Williams was doing anything else, such as altering the accident scene, is ridiculous.

"Thank God Suzanne Williams is concerned enough about her grandson to pick him off the cold cement road and put him in a seat," said Lane.

He said the senator has no memory of the accident, including the moments before the collision.

"If anybody thinks this is not a tragedy for Suzanne Williams, they are out of touch with reality," said Lane.

Brianna Michelle Gomez, 30, was in the other vehicle and died in the accident.

She was seven months pregnant. Her son was delivered by emergency C-section at a hospital.

According to Lane, the district attorney in Texas plans to "present it to the grand jury in February and we'll see what happens."

No one has been ticketed in the accident.

"Not every human tragedy must have a criminal charge to go along with it. Sometimes there are simply human tragedies, sometimes there are simply accidents," said Lane.

Williams remains in Texas where her son is still hospitalized. It's not clear whether Williams will be back in time for next week's start of the legislative session.
